  • Quote means: the quotation provided to you, the Customer, setting out the services to be provided by ECEC Events Calendar and ECRM, providing an itemisation of advertising costs, inclusions and exclusions and all applicable terms.
  • Order means: an order for services placed on the online booking platform with the intent to purchase advertising space or with our Hosts/Sellers to attend an event.
  • Contract means: the agreement you have entered into by purchasing the services to which these terms apply i.e. contracts between ECEC Events Calendar, ECRM and the Host/Seller, and ECEC Events Calendar, ECRM and the Customer.
  • Price means: the price payable for the services as advertised on our website in relation to orders between between the ECEC Events Calendar, ECRM and you, the Customer.

SECTION 2 - EXCLUSION OF COMPETITORS

  • If you are in the business of operating similar collaborative events website, social pages, blogs or calendars and engage in the collective/collaborative promotion of educational training, services, workshops etc specific to the Early Childhood Education and Care Sector, Families and Communities in Australia and Internationally for the purpose of providing them for a fee to users, whether they be business users or domestic users, then you are a competitor of www.ececevents.com.au and the Early Childhood Resources Market.
  • ECEC Events Calendar, (www.ececevents.com.au), and the Early Childhood Resources Market expressly excludes and does not permit you to use or access our website, to download any documents or information from its website or obtain any such documents or information through a third party.
  • If you breach our exclusion of competitors policy, then ECEC Events Calendar, (www.ececevents.com.au), and the Early Childhood Resources Market will hold you fully responsible for any loss that we may sustain and further hold you accountable for all profits that you might make from such unauthorised and improper use.

    SECTION 3 - OUR PRODUCTS 

    ECEC Events provides an online platform where early childhood professionals, families and our community can browse educational and training events happening around Australia in the Early Childhood Education and Care Sector. From time to time, international study tours may also be listed by our Hosts/Seller's.

    • These events may include: ECEC Conference, Workshop, Stickybeak Tours, In-Service Training, On-Line Training, Educator Wellness and other key education and training events.
    • The events calendar provides customers with varied layout formats for ease of viewing such as: full month, card, agenda and week.
    • All Event details are submitted by our event hosts/sellers directly to our platform for ECRM approval.
    • Sellers must include detailed event description including: date, time, duration, location, event agenda, event photograph and links to their own website for any further information, bookings and payment.
    • No event payments are accepted on our website, these are all made directly with the event host/seller on their website.
    • We have made every effort to provide an accurate representation of the products and services in ECEC Events Calendar using the details directly uploaded to our platform by  Event Hosts/Sellers. 
    • However, please note that colours or image appearance may differ from how they may appear on your screen due to the type of device you use to access the store and your device settings and configuration.
    • We do not warrant that the appearance or quality of any services purchased by you will meet your expectations or be the same as depicted or rendered in our event calendar. 
    • All descriptions of products/services are subject to change at any time without notice at our sole discretion of our event Host/Sellers and us.
    • We reserve the right to discontinue any event at any time and may limit the quantities of any events that we offer to any one person, geographic region or jurisdiction, on a case-by-case basis.


    SECTION 4 - ORDERS and PAYMENT
     

    ORDERS:

    • You represent and warrant that your purchases are for your own professional learning, childcare service and/or family are not for commercial resale or copying; in whole or in part.
    • We use our best efforts to ensure that the Charges for the Services advised to you are correct. 
    • The charges for the Services are in Australian dollars ($AUD), and are inclusive of goods and services tax (“GST”) unless otherwise clearly stated.
    • No event payments are accepted on our website, these are all made directly with the event Host/Seller on their individual websites.
    • Please ensure you have read in full all the details regarding the event and that you are able to meet all of the requirements of the event includingbut not limited to; full availability for event schedule, afford the costs associated with the event, familiarised yourself with the refund, transfer and/or cancellation policy, any event prerequisites of the Host/Seller.
    • When you place a booking with one of our Hosts/Sellers, you are entering into a legally binding purchase directly between yourself and event Host/Seller.
    • Event host/Sellers reserves the right to either accept or decline your order for any reason at their sole discretion.
    • Please confirm receipt of your event booking from the Host/Seller.
    • Upon receipt of your order confirmation, ensure all sales details are accurate and contact the Host within 7 days if any items need clarification or adjustment.
    • Individual Hosts/Sellers reserve the right to set and use their own payment methods.
    • Not all Hosts/Sellers will offer and accept the same payment services.
    • When purchasing Services from our Hosts/Sellers, you must pay for them:
      (a) at the time of booking the event, one-off Services, or an annual payment for ongoing Services, or a subscription to receive Services; or
      (b) on the monthly billing date or the annual billing date as advised to you in your Order Confirmation, if it is a purchase of ongoing Services, or a subscription to receive Services paid for on a monthly, half-yearly or annual basis; or
      (c) on the scheduled payment periods as advised to you in your Order Confirmation, if you choose a payment plan for your purchase of one-off Services, ongoing Services or a subscription to receive Services.

    PAYMENT:
    • Unless otherwise agreed by us in writing, the terms of payment for the services provided on this website are strictly prepaid at the time of original purchase. 
    • You may pay for the goods and services using the payment methods outlined by the relevant Hosts/Sellers.
    • If you are unsure about any of the Hosts/Sellers payment terms and conditions, please contact them directly to clarify your questions prior to finalising your booking with them.
    • Invoices will be issued and payable directly to the Host by the due date in respect of every event order, notwithstanding that the balance of the order has not been nor will be delivered for any reason.
    • Where any payment is not made by the due date, Hosts at their discretion, may be entitled to charge interest or a late payment fee on any overdue portion from the date the payment was due until the date payment is made (both dates inclusive).
    •  Please read Host T&C's thoroughly to ensure you fully understand their payment terms and conditions.
    • All payments must be made in Australian dollars only.
    • If the Hosts/Sellers cannot successfully process payment for your order, they reserve the right to cancel or reject your order at their sole discretion.


    SECTION 5 - PRICES AND BILLING 

    • All prices on our website are quoted in $AUD Australian Dollars only.
    • All prices on our website include GST unless clearly stated otherwise.
    • Prices, discounts and promotions are subject to change without notice by ECRM and Hosts/Sellers.
    • The price charged for a product or service will be the price in effect at the time the order is placed and will be set out in your order confirmation email.
    • Unless otherwise expressly stated, posted prices do not include shipping, handling, customs or import charges. 
    • Prices posted in our online stores may be different from prices offered in physical stores or in online or other stores operated by third parties.
    • We may offer, from time to time, promotions on the Services that may affect pricing and that are governed by terms and conditions separate from these Terms.
    • If there is a conflict between the terms for a promotion and these Terms, the promotion terms will govern. 
    • You agree to provide current, complete and accurate purchase, payment and account information for all purchases made at our stores.
    • You agree to promptly update your account and other information, including your email address, credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed. 
    • You represent and warrant that:
      (i) the credit card information you provide to our Hosts/Sellers is true, correct, and complete,
      (ii) you are duly and legally authorised to use such credit card for the purchase,
      (iii) charges incurred by you will be honoured by your credit card company, and 
      (iv) you will pay charges incurred by you at the posted prices, including shipping and handling charges and all applicable taxes, if any. 

    SECTION 6 - SHIPPING AND DELIVERY

    • The ECEC Events Calendar by ECRM is an events listing only platform.
    • We do not anticipate the postage of resources from our website at this time. 
    • If however, you do purchase services that require delivery - the Host's policies and procedures are applicable regarding delivery and the following also apply;
      • once hosts/sellers transfer products to the carrier, risk of loss passes to you the customer.
      • insurance of goods in transit is always highly recommended.
      • you acknowledge that any person accepting delivery of your posted order at the delivery address is authorised by you to receive your order.
      • if no one accepts delivery of your order at the delivery address, couriers may arrange for delivery at a different time and they may charge you an additional delivery fee or,
      • the delivery may be left at your premises with your prior approval.
      • risk in the goods passes to you on delivery.
      • all quoted delivery or consignment dates are estimates only.
      • Hosts are not responsible for delays caused by shipping carriers, customs processing, natural weather occurrences or events outside their control.

    SECTION 7 - PROMOTIONS
    • From time to time, Event Hosts and ECRM may elect to off special promotional pricing options on the ECEC Event Calendar website. 
    • Both reserve the right to amend or cancel their promotions at any time, without prior notice.
    • Special prices, promotions, offers and discounts maybe for a limited time only, subject to product/services availability, and otherwise subject to change.
    • Only one promotional code can be used per customer, per transaction.


    SECTION 8 - INTELLECTUAL PROPERTY

    • Our Services, including but not limited to all trademarks, brands, text, displays, images, graphics, product reviews, video, and audio, and the design, selection, and arrangement thereof, are owned by ECEC Events Calendar, the Early Childhood Resources Market, Maureen Hayes, its affiliates or licensors and are protected by U.S. and foreign patent, copyright and other intellectual property laws. 
    • These Terms permit you to use the Services for your personal, non-commercial use only.
    • You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on the Services without our prior written consent.

    • However, any sales and purchases you make in our Store are made directly with ECRM and not Shopify.
    • By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and ECEC Events Calendar and ERCM, including any injury, damage, or loss resulting from purchased products and services.
    • You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with ECEC Events Calendar and ECRM.

    SECTION 12 - PRIVACY POLICY

    • All personal information we collect through the Services is subject to our Privacy Policy, which can be viewed here [LINK], and certain personal information may be subject to Shopify's Privacy Policy, which can be viewed here.
    • By using the Services, you acknowledge that you have read the quoted and linked  privacy policies. 
    • Because the Services are hosted by Shopify, Shopify collects and processes personal information about your access to and use of the Services in order to provide and improve the Services for you.
    • Information you submit to the Services will be transmitted to and shared with Shopify as well as third parties that may be located in other countries than where you reside, in order to provide services to you.

      (b) reproduce, duplicate, copy, extract, sell, resell or exploit any portion of the Services;

    • Our Host's have years of experience in their relative fields of expertise. Rebranding and plagerism of their educational materials/resources will result in the immediate suspension from our platform/website and possible legal action.

    • The information presented on or through the Services is made available solely for general information purposes. We do not warrant the accuracy, completeness, or usefulness of this information.
    • Any reliance you place on such information is strictly at your own risk.
    • We disclaim all liability and responsibility arising from any reliance placed on such materials by you or any other visitor to the Services, or by anyone who may be informed of any of its contents.

    • TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO CASE SHALL ECEC Events Calendar and the Early Childhood Resources Market and ECEC Events Calendar, OUR PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS OR LICENSORS, OR THOSE OF SHOPIFY AND ITS AFFILIATES, BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING, WITHOUT LIMITATION, LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, REPLACEMENT COSTS, OR ANY SIMILAR DAMAGES, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, ARISING FROM YOUR USE OF ANY OF THE SERVICES OR ANY PRODUCTS PROCURED USING THE SERVICES, OR FOR ANY OTHER CLAIM RELATED IN ANY WAY TO YOUR USE OF THE SERVICES OR ANY PRODUCT, INCLUDING, BUT NOT LIMITED TO, ANY ERRORS OR OMISSIONS IN ANY CONTENT, OR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF THE USE OF THE SERVICES OR ANY CONTENT (OR PRODUCT) POSTED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE SERVICES, EVEN IF ADVISED OF THEIR POSSIBILITY. 


    SECTION 22 - INDEMNIFICATION

    • You agree to indemnify, defend and hold harmless ECEC Events Calendar, the Early Childhood Resources Market, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities or claims, including reasonable attorneys' fees, payable to any third party due to or arising out of
      (1) your breach of these Terms of Service or the documents they incorporate by reference,
      (2) your violation of any law or the rights of a third party, or
      (3) your access to and use of the Services. 
    • We will notify you of any indemnifiable claim, provided that a failure to promptly notify will not relieve you of your obligations unless you are materially prejudiced.
    • We may control the defense and settlement of such claim at your expense, including choice of counsel, but will not settle any claim requiring non-monetary obligations from you without your consent (not to be unreasonably withheld).
    • You will cooperate in the defense of indemnified claims, including by providing relevant documents.

    • These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the federal and state or territorial courts in the jurisdiction where ECRM is headquartered which is Lake Macquarie, New South Wales, Australia.
    • You and the ECEC Events Calendar and ECRM consent to a venue and personal jurisdiction in such courts in Newcastle, New South Wales, Australia.

    • The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms. 
    • The order, grammar and punctuation of the policy headings will also not limit or otherwise affect these Terms.

    • We reserve the right, in our sole discretion, to update, change, or replace any part of these Terms of Service by posting updates and changes to our website.
